NDMP is the right way of doing this. It will backup the ACLs correctly.
Contrary to popular belief, you don't have to locally attach tape drives
to the NetApp to do NDMP, although you will have to have the correct
Legato license. For network based NDMP backups, read the chapter in the
Networker Admin Guide.

We're looking at the feasability of backing up a NetApp file system that
uses both UNIX style ACL's and CIFS ACL's. If I back it up as an NFS
mount
on the UNIX side, the CIFS ACL's are lost upon restore. If I back it up
as a
CIFS mount on the Windows side, the Unix  ACLs' are lost upon restore.

Is there a way of backing up this file system via Networker that
preserves
both ACL's? Can NDMP do this? 

We don't currently use NDMP to back the NetApp but are instead using NFS
mounts on the backup server (UNIX).
