I'm confident, as a non-MS expert and fellow Networker Backup admin, that this
is a Window 2008 R1 & R2 limitation.
During testing a month of testing in 2009 (Windows 2008 R1 SP1 as a Domain
Controller with Networker client 7.5.1), almost every file under C:\Windows
would not backup (all files created during OS installation). Windows 2008 R1 &
R2 (Vista & Windows7 also) have WRP:

Only the Windows service account "TrustedInstaller" has permissions to modify
these 'protected' files.
Networker can not create ASR nor backup the 'protected' files.
I reported to EMC the list of files Networker client was unable to backup, and
they took nearly 2 months to answer "We have replicated the same results".
My planned support for Windows 2008 is that the OS will have to be installed
manually and then Networker can restore data. I have never relied on 'bare
metal' restores.
During testing we interested in the Active Directory backups and were able to
successfully backup the server with saveset ALL, delete and OU from Active
Directory, and restore the OU with Networker. The only caveat was the
"Networker Admin Guide" omitted the need to include the "VSS System Services"
in the restore targets.
Special note, Windows 2008 R1 with SP2 broke my backup client 7.4.5 & 7.5.1.
Networker client 7.5.2 is working again.
