Any idea about what to check for to see if is a hardware problem (the library is new but it can be defective), tape problem (I've tested more than 20 tapes all with the same problem) or software (Legato + Windows + Drivers).

Are you sure that the drives are in the correct order ? Try to re-configure the library again with the drives swapped.
