Backing up c$\boot\BCD?

This occurs with all my Windows 2008 boxes. This file, along with c$\boot\BCD.log, are in use by another process and can't be backup up by TSM. Reading up on that file seems to suggest it's needed for boot. How can I fix this issue? Thanks.

the first reply from ibm was to add the following line:
snapshotproviderfs VSS

which we did on friday
which did NOT help at all.
