I am not sure just when they got deleted from the filesystem.
Does expiration based on management classes start based on the deletion
date from the filesystem or when last backed up. Its supposed to keep them
for 365 days. It is possible that they were only deleted less then 365 days ago.

Yes, exactly. The clock does not start ticking on deleted files until they are 
deleted. If you delete a file on 1/1/2008, and the management class is 
4/2/365/365 (as yours was), and TSM doesn’t back up that filesystem until early 
a.m. 1/2/2008, then the file will not be a candidate for expiration until 
expiration occurs on 1/1/2009 (2008 being a leap year). The clock doesn’t start 
ticking until TSM recognizes that the file is gone.
