Cheers "M" have tried this & I can confirm that it does work.

Set up a policy to backup /app/site (contains many sub-directories & files)
Set up an exclude list for same of /app/site/*/
Ran backup & checked that only files within /app/site & NOT sub-directories 
were backed up.
