No in this case it is an Exchange 2003 Server.
It happens only sometimes on different servers (members and DC's)

  One question Martin, is it domain controller you are trying to backup? I had 
this happen to one of the DC servers, and turned out that this server was in 
constant replication mode, so i never was able to backup sys state fully.
other way we use to recover sysstate on 2000/2003 servers is native ntbackup 
utility and just dump it to a flat file, then keep it someplace on the network 
or on the tape.
