This may be true, but I have been backing up a linux (RH 7.2, 2.4.18-17.7.x)
with ext3 filesystems using both NW 6.1.3 and 7.0 without any problems.

You might try limiting your investigations to a smaller set of files in a test
saveset to figure out why it might be trying to back them up.
