i keep gettting these 2 messages everynight durning backup. I have 2 other identical servers that don't get them. I've rebooted the server still happens. The systems state backs up ok. I've searched around for help on this and not much is out there. any ideas?

again, this is a windows 2008 r2 64 bit domain controller, recently set up.
 
I looked at the technote. can't say as it really relates to my issue. My systemstate backup doesn't fail. I wonder if I can get this file off the OS install cd?
 
I've experienced this on dozens of clients. I've resolved the situation by upgrading most TSM clients to 6.1.3.3, or by making a dummy file by the same name.

Most of the time the issue has to do with VSS writers having something bad in some sort of index. I didn't read too deep into it once the client upgrades started fixing the issue.

I haven't gone the dummy file road myself so I'm not sure of any risks.

ENHANCE SYSTEM STATE BACKUP SO THAT IT CAN SKIP FILES ENUMERATED BY THE SYSTEM WRITER THAT DO NOT ACTUALLY EXIST ON THE SYSTEM

This would be exactly what you are seeing in your situation.
