redistribution or EULA for tsmapi.dll, etc. files.

Hi,
I'm am working for a company that develops a 3rd party backup application, and we are developing an option that will use the following files to push our data to TSM:

dscenu.txt
dsmntapi.dll
tsmapi.dll
tsmutil1.dll

I can't find anything on IBM's site that says we can or can't redistribute these files. Does anyone know where this might exist on their site?

Also, if I can't redistribute them, is there any thing anywhere that says that a customer can use these files without paying for a baclient license?

By way of logic, these files belong in part to an application that is bought and paid for. Following this line of thought, these files will need some sort of payment or "royalties" for its use. If you read the Software Agreement carefully (and any software agreement for that matter) use of the Software is protected under copyright Laws.

The specific software licensing reference information is described in the product announcement letter and that refers to the actual licensing agreement: http://www.ibm.com/software/sla/sladb.nsf and the base licensing agreement.

In those agreements are everything that you can and cannot do with the software.

FYI, the API is part of Tivoli Storage Manager or the Tivoli Storage Manager Extended Edition.
