Seems messy, does anyone know if there are tarballs for the agent for > 7.0?

Someone mentioned that include/exclude bug, appears there is a 
downloadable fix now:
Unix/Linux Only:

(UPDATED FIX)(ET2115722 )   Exclude and include lists are being recognized 
by user and catalog backups. This may lead to unintended exclusions during 
backup.
