NDMP can indeed accomplish this. We have unix and ntfs style qtrees (even
a mixed one - don't ask) that get backed up via NDMP with no ACL issues
what so ever.
IIRC - You will need to purchase an NDMP client license from EMC for each
filer to allow Networker to back them up using that protocol. NDMP
licenses are sold in tiers based on the model(s) of NetApp you have.

[Networker] Backing up Mixed ACL's
We're looking at the feasability of backing up a NetApp file system that
uses both UNIX style ACL's and CIFS ACL's. If I back it up as an NFS mount
on the UNIX side, the CIFS ACL's are lost upon restore. If I back it up as
a
CIFS mount on the Windows side, the Unix ACLs' are lost upon restore.
Is there a way of backing up this file system via Networker that preserves
both ACL's? Can NDMP do this?
We don't currently use NDMP to back the NetApp but are instead using NFS
mounts on the backup server (UNIX).
