The Legato business rule in this regard is if you have a cluster node that
you want to backup then you must have a cluster client license.  The client
checks for the presence of cluster processes - if they are running (or
installed?) if disables client backups until a license has been installed.

We are not using any of the networker cluster features - they just want the
money.  Please correct me if I am worng.

Sorry for the sour grapes here but this reminds me of taxation w/o
representation.
