I have seen such errors randomly. This could be a system overload or a NW client 'hickup'. In most cases, a simple retry would do the job - may I suggest that you restart the NW client service first.

Ah, I see. There is no mechanism to inform the NetApp of what to exclude. So if I want to exclude that volume have to explicitly specify the ones I do want to back up instead of using "All" it appear

Quite a bunch of customers who want to create new ones will need more detailled info. On the other hand, the existing ones are to 95% sufficient, IMHO. Modifying the action is normally all you need.
