IMHO indicating a changed file as a warning is o.k. Do not forget that from the 
probe to the time of the actual backup hours may have passed - it would be most 
unlikely if all files would remain unchanged. However, for consistency reasons 
you of course want to backup the file(system) as is so NW will do right by just 
issuing a warning.
