as far as i can see a W2K8 disk is considered to be 'critical' if it stores an 
*.exe which runs/is registered as a service.

The downsides of this whole behavior:
  - The DR backups are only run during full backups. So you should run one 
daily ;-)  ...  or you might miss a new one in the interim ;-)
  - That one small EXE file may result into a huge disk backup of several TB
  - It is impossible to recover these EXE files individually as the will be 
SILENTLY excluded during a backup
       Just run a manual backup of the ..\nsr\bin directory and verify that 
nsrexecd.exe & nsrpm.exe will be excluded (and you will not even receive a 
notice :-(
       So NW and/or Windows (i don't really care) overrules your file selection!
  - You can recover the whole disk but if such EXE files is missing, the whole 
process could be useless

To overcome that that issue it is best practice to have separate disks which 
only contain data file. As we cannot do this with all applications, we  have 
decided to write a PowerShell script which
  - collects all executables which are registered to run as a service
  - converts their full path names (with '\', ' ' etc.) into a simple but long 
file name (saving the original location)
  - copy the original file using the long file name to a known subdir on the C: 
drive
>From here you could recover your file(s) back at the end of your data restore 
>process.
