You cant use "VSS:*=off" as an option in save operations for 2008, VSS is
always used when doing backup with Legato and cant be disabled, we have
numerous problems with backup of Win 2008 and have ongoing communication
with EMC, testing different p releases etc without much luck for far,
currently we using 7.5.1 p7 with a lot of custom settings to fix this
problem.

According to EMC the root cause is the VSS writers in the OS.

According to the info we have got from EMC The NW_7.5.1.7 Cumulative Fix is
a baseline release for Win2008 Server customers.
