Yes, that's a common problem, which is why if you're in an audited
environment it's best to ensure it's done by a company that can
certify the records of the transferred data.
The alternative I prefer in the land-of-virtualisation is to
virtualise the server that is being phased out, have a couple of
standalone tape drives capable of working with the system attached,
and let it sit there waiting for use – conducting periodic tests of
course to ensure recoveries are still viable, etc.
