I think it's pretty irresponsible that Microsoft will create a product
that will let you create files that you can't backup.  (Or, rather, that
the POSIX API that NFS uses has some level of access to the file system
that Explorer and the backups APIs don't have.)  I don't have a
solution, or a work around for this, except for a hope that Microsoft
will fix it (either as a patch or in Vista.)  If I understand things
right, they're going to roll Services for UNIX into the core Vista
Server - maybe then they'll have to acknowledge and fix this.  (This is
mainly an FYI for people using SFU.)

I agree completely.  SFU is one of those after-thought products so MS said 
they could interoperate with everything.  However, the native tools aren't 
POSIX compliant and can't understand differing cases; they use the 
standard Windows API instead of the POSIX-compliant one.  It's a great 
idea, but you're seeing the problems with it now.

It would seem from your post that ntabckup and the networker client for 
windows are not using the POSIX-compliant API.  As a result they can't 
handle differing cases.

At least some components of SFU will be integrated into 2003 R2 later this 
year or early next, but not installed by default.  I don't know if this 
will change the base functionality of core windows commands (i.e. copy, 
del, etc.), but it may be a step in the right direction.  If anything, 
it's something to as MS about.

I would seriously doubt that MS would simply turn on case sensitivity in 
its OS by making everything POSIX compliant in Vista.  It would definitely 
solve some problems, but would undoubtedly create many, many more. Another 
option may be to see if Legato will provide a client that uses the POSIX 
APIs; a long shot, but another avenue to explore.
