Short answer, Yes for EXT3

Look at Chapter 4 of the Unix and Linux: Backup-Archive Clients
Instalation and User's Guide:
- Pre-backup considerations
  - File system and ACL support

There is a table listing the different filesystems and if it has ACL
support.
